1. About us

Sebstah IT AB, Swedish company reg. no. 559427-3145, registered office Helsingborg, address Vagnmakarevägen 150, 254 77 Fleninge, Sweden (“Sebstah IT”, “we”), develops and runs websites, web applications, mobile apps, SaaS platforms and AI solutions, and offers hosting, SEO and related digital services.

2. Scope

These terms apply to agreements with businesses, meaning companies, associations and other organisations (“the client”, “you”).

If a quote or written agreement differs from these terms, the quote or agreement applies.

Our packages and prices are aimed at businesses. If we exceptionally deliver to a private individual, we make a separate agreement, and consumer protection law then also applies, including the right of withdrawal.

3. Agreement

A request through the website's forms is not binding on either party.

An agreement is made when we have confirmed an order in writing, for example by email, or when both parties have accepted a quote or an agreement.

4. Services

Starter and Scale are subscriptions that include what is described for each package on the website when the agreement is made, including building the website, hosting, SEO and support. Enterprise and other assignments are quoted separately.

Work beyond what is included is done by agreement and charged according to the quote or our current hourly rate.

We work actively to make you visible in search engines, but cannot guarantee a specific ranking or amount of traffic, since search engine algorithms are controlled by third parties.

5. Prices and payment

All prices are in Swedish kronor, unless stated otherwise. Sebstah IT is not registered for VAT, so no VAT is added. If we become VAT-registered, VAT will be added as required by law, and we will let you know in advance. Prices in US dollars exclude any applicable taxes.

Any setup fee is invoiced when the agreement is made. The subscription fee is invoiced in advance per month or per year, depending on the billing period you choose. With yearly billing you pay for 9 months and get 12.

Payment terms are 30 days net from the invoice date.

For late payment we are entitled to interest under the Swedish Interest Act, plus reminder fees and compensation for debt collection costs as provided by law. If payment is still not made after a reminder, we may, after written notice, pause the service until payment is received.

We may change the subscription price with at least one month's written notice. You then have the right to terminate the agreement as of the date the change takes effect.

6. Term and termination

The subscriptions have no minimum term.

With monthly billing, the agreement can be terminated with one month's notice.

With yearly billing, the agreement runs for the period paid and then renews for one year at a time, unless terminated at least one month before the period ends.

Termination must be made in writing, for example by email to info@sebstah.com. Fees paid in advance and the setup fee are not refunded.

Either party may terminate the agreement with immediate effect if the other party materially breaches it and does not remedy the breach within 30 days of written notice, or if the other party becomes bankrupt or can otherwise be assumed to be insolvent.

When the agreement ends, we help move the website, the domain and the content to you or to the provider you choose.

7. Ownership and rights

You own your domain and your content, such as texts, images and logos.

Once the setup fee has been paid, you also own the finished design and the code developed specifically for you.

We keep the rights to general tools, components and know-how that we use across projects. You may use them freely as part of your website or solution.

We may show the work we have done for you in our portfolio and mention you as a client, unless you tell us you don't want that.

8. Client responsibilities

You are responsible for providing material, such as texts, images and logos, as well as feedback and approvals on time. Delays caused by late material or decisions push back the delivery.

You are responsible for having the right to use the material you give us and for making sure the content on your website complies with applicable law.

9. Operation and support

We aim to keep your services available around the clock and fix faults within a reasonable time. Planned maintenance and disruptions at subcontractors, such as hosting providers, may temporarily affect availability.

Support is included according to your package: by email in Starter and priority support in Scale.

10. Personal data

When we process personal data on your behalf, for example data from forms on a website we host, we act as your processor and sign a data processing agreement with you.

How we process personal data ourselves is described in our privacy policy.

11. Limitation of liability

We are not liable for indirect or consequential damages, such as loss of profit, loss of data or loss of production.

Our total liability under an agreement is limited to the amount you have paid us in the last twelve months.

These limitations do not apply to damage caused intentionally or through gross negligence.

Neither party is liable for delays or failures caused by circumstances beyond its control, such as strikes, decisions by authorities or major disruptions to the internet or power grid (force majeure).

12. The website

The information on sebstah.com is general and may change. What applies to your assignment is set out in the quote or agreement.

The content of the website, such as texts, images and design, belongs to Sebstah IT or our clients and may not be copied without permission.

13. Changes to these terms

We may update these terms. We notify you in writing at least one month before changes that affect existing agreements take effect.

14. Governing law and disputes

Swedish law applies to these terms and to agreements between us.

Disputes are settled by the general courts of Sweden, with Helsingborg District Court as the court of first instance.
